1. Overview
Welcome to Fetchkind. In these Terms, “we”, “us” and “our” mean Fetchkind.
Fetchkind operates this website and online store, including all related information, content, features, tools, products and services we make available to you (the Services). Our store is hosted by Shopify, which provides the e-commerce platform that allows us to sell our products to you.
These Terms of Service, together with any policies referred to in them, set out the terms on which you may use our Services and purchase products from us.
Please read these Terms carefully before using our Services. By accessing, browsing, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use our Services.
Nothing in these Terms limits or excludes any rights you may have under applicable UK consumer law.

3. Access to the Services and accounts
To purchase from our store, you must be at least 18 years old or have the involvement of a parent or legal guardian.
You may be asked to provide information including your name, email address, billing address, delivery address and payment details. You must ensure that the information you provide is accurate, complete and up to date.
If you create an account, you are responsible for keeping your login details secure and for all activity under your account. You must not transfer or sell your account to anyone else.
We may suspend or restrict access to the Services if we reasonably believe there has been misuse, fraud, or a breach of these Terms.
4. Our products
We try to ensure that product descriptions, images and other content on our website are accurate and up to date.
However:

colours may vary slightly depending on your device or screen settings;

product placement, scale and print appearance may vary slightly from on-screen mock-ups;

as many of our products are made to order, small variations may occur.
Nothing in this section affects your statutory rights if goods are faulty, not as described, or not of satisfactory quality. UK consumer law requires goods to be as described, of satisfactory quality and fit for purpose.
We may update or discontinue products at any time and may limit purchase quantities where reasonably necessary.
5. Orders and contract formation
When you place an order, you are making an offer to buy products from us.
Your order is only accepted when we send you an order confirmation email or otherwise confirm acceptance. Until then, we may decline or cancel an order, for example if:

a product is unavailable;

there is an error in pricing or product information;

we reasonably suspect fraud or misuse;

we are unable to process payment.
Please check your order carefully before submitting it. Because many Fetchkind products are made to order, including personalised items, changes or cancellations may not be possible once production has started.
6. Prices, payment and taxes
All prices shown on our website are in GBP (£) unless stated otherwise.
Where applicable, VAT. delivery charges and any other applicable charges will be shown during checkout before you place your order.
You agree to provide current, complete and accurate payment and billing information for all purchases. By placing an order, you confirm that you are authorised to use the payment method provided.
We reserve the right to change prices, promotions and discounts at any time, but changes will not affect orders already accepted.
7. Delivery
We will provide delivery information, including estimated delivery times and charges, during checkout.
Delivery times are estimates only unless we have expressly agreed otherwise. We are not responsible for delays caused by events outside our reasonable control, including courier delays, customs delays, severe weather or peak seasonal demand.
Unless otherwise agreed, goods should be delivered without undue delay and usually within 30 days. Under UK distance-selling guidance, risk generally passes to the consumer when the goods are delivered to them or to a person they identify to receive them.

8. Your right to cancel
If you are a consumer in the UK, you may usually have the right to cancel certain online orders within 14 days of receiving the goods, in line with the Consumer Contracts Regulations.
However, this cancellation right does not usually apply to:

goods made to your specifications; or

clearly personalised items.
Because many Fetchkind products are made to order and may be personalised, your right to cancel may be limited once production has begun.
If you wish to cancel an order that is eligible for cancellation, please contact us at support@fetchkind.co.uk as soon as possible with your order number.
This section does not affect your rights if goods are faulty, damaged, incorrect or not as described.
9. Refunds, replacements and faulty items
We want you to love your Fetchkind order. If something is wrong, please contact us and we will do our best to help.
If your item arrives:

damaged,
-
defective,
-
incorrect, or
-
not as described,
please email support@fetchkind.co.uk with your order number, a description of the issue, and photographs where relevant.
Our Refund Policy applies alongside your statutory rights. Nothing in these Terms limits your legal rights under UK consumer law.
10. Personalised and made-to-order products
Many Fetchkind items are made to order and some may be personalised.
It is your responsibility to check all personalisation details carefully before placing your order, including spelling, names, dates and other custom information.
We are not responsible for mistakes in personalisation submitted by you, unless we have made an error in producing your item.
Personalised and made-to-order items may not be eligible for cancellation or change after production has started, except where they are faulty, damaged, incorrect or not as described.
11. Intellectual property
All content on the Services, including text, graphics, logos, product designs, images, artwork, site layout and branding, is owned by or licensed to Fetchkind and is protected by intellectual property laws.
You may use the Services for personal, non-commercial use only. You must not copy, reproduce, republish, distribute, modify or commercially exploit any part of the Services without our prior written permission.
“Fetchkind” and our branding, logos, designs and slogans are our property or used under licence. All other trade marks remain the property of their respective owners.
12. Acceptable use
You must use the Services lawfully and must not:

use the Services for any unlawful, fraudulent or harmful purpose;

interfere with the operation or security of the website;

upload malicious code, viruses or harmful material;

scrape, crawl or harvest data from the website without permission;

infringe our rights or the rights of any third party;

We may suspend or terminate access to the Services if you breach these Terms.
13. Third-party tools and links
Our Services may include links to third-party websites, apps or tools, including services provided through Shopify or other providers.
We are not responsible for the content, policies or practices of third-party websites or services. If you choose to use them, you do so at your own risk and subject to their terms.
14. Shopify
Our store is hosted on Shopify. However, any contract for the purchase of products from our store is between you and Fetchkind, not Shopify.
To the extent permitted by law, Shopify is not responsible for the products you purchase from us, or for the fulfilment of orders placed through our store.
15. Privacy and personal information
We process your personal information in line with our Privacy Policy.
Because our store is hosted by Shopify, certain personal data may also be processed by Shopify and its service providers in order to operate the store, process payments, manage orders and improve services.

16. Reviews, comments and feedback
If you send us reviews, suggestions, ideas, comments, photos or other submissions, you confirm that you have the right to share them.
You grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish and display that content for the purpose of operating, marketing and improving Fetchkind, unless we agree otherwise with you.
You must not submit anything unlawful, misleading, abusive, defamatory, infringing, or otherwise objectionable.
We may remove content from our website or channels if we reasonably believe it breaches these Terms or the law.
17. Errors and inaccuracies
We try to ensure that all information on our website is accurate, but occasionally errors may occur, including in product descriptions, prices, promotions, shipping details or availability.
We reserve the right to correct errors, update information, or cancel affected orders where reasonably necessary. If this happens after you have placed an order, we will contact you using the details you provided.
18. Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for:

death or personal injury caused by negligence;

fraud or fraudulent misrepresentation; or

breach of your statutory consumer rights.
Subject to the above, we are responsible for losses you suffer as a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, but we are not responsible for losses that are not foreseeable.
We do not accept liability for business losses. Our Services and products are intended for personal, domestic and private use only.
To the extent permitted by law, we are not responsible for:

delays or failures caused by events outside our reasonable control;

incompatibility between the website and your device, browser or software;

indirect or consequential loss in a business context.
UK rules on unfair terms mean consumer contract wording must be fair and clear, and unfair wording is not binding on consumers.
19. Events outside our control
We are not liable for any delay or failure to perform our obligations where this is caused by events outside our reasonable control, including natural events, strikes, internet outages, supplier failures, transport disruption, severe weather or government action.
If this happens, we will try to minimise the impact and contact you where appropriate.

We may update these Terms from time to time.
Any changes will be posted on this page with an updated “Last updated” date. If we make material changes, we will take reasonable steps to bring them to your attention where required by law.
Your continued use of the Services after updated Terms are posted will mean you accept the changes, to the extent permitted by law.
21. Severability
If any part of these Terms is found to be unlawful, invalid or unenforceable, the rest of the Terms will continue in full force and effect.
22. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales, unless you are based in another part of the UK where mandatory local consumer law applies.
If you are a consumer, you may bring legal proceedings in the courts of the part of the UK where you live. If we need to enforce these Terms against you, we will do so in the courts of the relevant part of the UK in which you are resident, where required by law.
